Agency is a fiduciary relationship between a seller and the Agent (Broker-in-charge). A written agency agreement is required to establish a seller agency relationship. By signing an exclusive right to sell, i.e., exclusive right to sell agreement listing agreement, your real estate agent is required by law to provide you with fiduciary duties to include loyalty, obedience, disclosure, confidentiality, reasonable care, diligence, and accounting. In doing so, the agent must represent and promote your best interests above all other interests.

Trust and confidence are paramount in an agency relationship.

If you are serious about selling real estate, you owe it to yourself to ensure your confidential information is kept confidential.

Obligations of parties:
For Agent: obedience, full disclosure, loyalty, reasonable care and diligence, accounting, confidentiality.

For client: good conduct, reimbursement, indemnity, opportunity, compensation, good faith.
