Agency is a fiduciary relationship between a Buyer and the Agent (Broker-in-charge). A written agency agreement is required to establish a buyer agency relationship. By signing an exclusive right to buy, buyer agency agreement, your real estate agent is required by law to provide you with fiduciary duties to include loyalty, obedience, disclosure, confidentiality, reasonable care, diligence, and accounting. In doing so, the agent must represent and promote your best interests above all other interests. Agent may not provide ANY professional services without an agency relationship.

Trust and confidence are paramount in an agency relationship.

You should never agree to look at homes or have any significant real estate discussion with an agent unless you have signed an agency agreement. Without the written agreement, your rights and interests are cannot be protected by law. To ensure all your rights are protected, to include confidential information, you must ask the agent for Agency Representation, like exclusive right to buy buyer agency contract.

If you are serious about buying real estate, you owe it to yourself to ensure your confidential information is kept confidential. This will most likely be the largest investment you will ever make.

Obligations of parties:
For Agent: obedience, full disclosure, loyalty, reasonable care and diligence, accounting, confidentiality.
